Plain-language summary

TradeFloWins is an educational app for personal market study and documentation. It is not financial advice, not a broker, and not a trade-execution platform. Scores, regimes, alerts, and theses are for learning and journaling—not guarantees. Use is at your own risk.

1. Agreement

By downloading, installing, accessing, or using TradeFloWins (the “App”), you agree to these Terms of Use and our Privacy Policy. If you do not agree, do not use the App.

We may update these Terms; the dates above will change. Continued use after an update means you accept the revised Terms.

2. Who may use the App

• You must be able to form a binding contract under applicable law.
• You must meet App Store age requirements; the App is not directed at children under 13.
• You are responsible for complying with laws that apply to you.

3. Educational purpose — no advice, no brokerage

3.1 What the App is

Educational market analysis and personal documentation tools, which may include structure-oriented analysis concepts, educational confluence scoring, thesis journaling, learning dashboards, optional premium educational features, and market data display from providers you enable.

3.2 What the App is not

• Financial, investment, tax, legal, or trading advice
• A recommendation to buy, sell, hold, or short any instrument
• A broker, investment adviser, exchange, or fiduciary
• A platform that executes or guarantees trades
• A substitute for professional advice or your own due diligence

3.3 No predictive guarantees

Past scores, signals, regime labels, volume trends, educational overlays, thesis health, alerts, or other outputs do not predict or guarantee future prices or outcomes. Markets involve risk of loss.

3.4 Your decisions

All trading and investment decisions are made entirely by you at your sole risk. You are solely responsible for research, risk management, and compliance.

4. License

We grant a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple devices you own or control, as permitted by App Store rules. You may not reverse engineer (except as allowed by law), commercially resell the App, remove notices, or use the App unlawfully. All other rights are reserved.

5. Device and local data

The App is local-first: journal and related records generally live on your device unless you export or share them. You are responsible for device security. Deleting the App or using reset features may permanently remove data. We are not obligated to recover deleted or lost data.

6. Market data and third parties

Market data may come from third parties. Accuracy, delays, and interval support vary; some free tiers remap intervals (e.g. 4-hour to 60-minute bars). You are responsible for API keys and provider terms. Apple and diagnostic providers (e.g. Crashlytics in Release/TestFlight) apply their own terms.

7. Premium and payments

• Some features may require purchase via Apple In-App Purchase.
• Payments are processed by Apple; manage subscriptions in iOS Settings → Apple ID → Subscriptions.
• Refunds follow Apple’s policies unless mandatory local law requires otherwise.
• Premium unlocks advanced educational tools—not a promise of better trading results.

8. Alerts

Optional alerts are educational notifications, not trade instructions. Delivery depends on device, network, and OS limits. Do not rely on alerts as a complete risk-management system.

9. Acceptable use

Do not abuse the App or support channels, disrupt service, misrepresent our endorsement of trades, or use the App for unlawful purposes. We may suspend access for violations or legal risk.

10. Intellectual property

The App, branding, and software are owned by us or our licensors. Content you write in local journals remains yours. Feedback you send may be used without obligation unless a separate written agreement says otherwise.

11. Disclaimer of warranty

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND ALL CONTENT, SCORES, DATA, AND ALERTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant uninterrupted or error-free service, or accurate or timely market data.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE AND OUR PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY TRADING LOSSES, ARISING FROM USE OF THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR CLAIMS RELATED TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) AMOUNTS YOU PAID US (VIA APPLE) FOR THE APP OR PREMIUM IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR (B) USD $50 (or the minimum amount required by applicable law, if higher).

Trading and investment losses after using educational information in the App are your sole responsibility.

13. Indemnity

To the maximum extent permitted by law, you agree to indemnify and hold us harmless from claims arising out of your use of the App, your trading decisions, your violation of these Terms or law, or misuse of market-data keys. Consumer protections that cannot be waived under your local law remain available.

14. Apple-specific terms

• These Terms are between you and TradeFloWins LLC, not Apple (except rights Apple reserves).
• Apple has no obligation to provide maintenance or support for the App.
• Apple is a third-party beneficiary entitled to enforce these Terms as they relate to Apple’s rights.
• You represent you are not subject to applicable U.S. embargoes or prohibited-party lists where required.

16. Termination

You may stop using the App by deleting it and canceling subscriptions through Apple. We may suspend features or distribution for breach, legal requirements, or product discontinuation. Survival clauses (disclaimers, liability, IP, governing law) continue after termination.

17. Governing law and disputes

Governed by the laws of the Commonwealth of Virginia, United States, except where mandatory consumer laws of your residence apply.

Dispute resolution: try informal resolution by emailing [email protected] and allowing thirty (30) days; then exclusive venue in state or federal courts in Virginia unless mandatory law requires otherwise. Class-action waivers are not asserted unless later added after counsel review.

18. Miscellaneous

These Terms, the Privacy Policy, and Apple-required terms form the agreement for App use. Unenforceable provisions are severed. No waiver by silence. You may not assign without consent; we may assign to a successor. English controls if translations conflict, unless local law requires otherwise.
